The lawsuit concerns the refusal to release inspection reports from the butcher shop of Federal Minister of Food and Agriculture Alois Rainer (CSU).

The dispute began when Alois Rainer, in his capacity as a butcher, requested access to his own shop's inspection reports to review food safety compliance. However, the district office declined the request, citing reasons related to data protection and confidentiality of the reports.

Foodwatch, on the other hand, believes that citizens should have the right to view the results of food inspections, regardless of the business or individual involved. The legal basis for Foodwatch's information request is the Consumer Information Act (VIG).

The timeline of events began on May 9, 2025, when Foodwatch requested the inspection results of the last five years for Alois Rainer's business from the Straubing-Bogen district office. Six days later, there was an inspection at the butcher shop, and Alois Rainer closed it the same day.

The district office consulted with Alois Rainer after receiving the request, and he reportedly requested "initial access to the files and the release of the name and address of the inquiring person." The district office subsequently denied the request based on the closure of the business.

The denial of access to the inspection reports was challenged by Foodwatch as a matter of public interest. Chris Methmann, the CEO of Foodwatch, questioned the timing of Alois Rainer closing his butcher shop after the request.

Despite the district office's denial, Foodwatch maintains that the public has a right to transparency regarding food safety inspections. Withholding such information, they argue, undermines consumer rights and trust in food safety regulation.

The Federal Ministry of Agriculture does not see a justified public interest in the conditions at Alois Rainer's butcher shop. A ministry spokesperson stated that Alois Rainer made the decision to close the butcher shop before his appointment as federal minister.

The Straubing-Bogen district office denies Foodwatch's active legitimacy to make such an inquiry. However, Foodwatch views this as a routine procedure and is determined to fight for the right to access the inspection reports.
