The U.S. government has been grappling with the urgent issue of illicit e-cigarette products flooding the market, posing threats to U.S. sovereignty, public health, and law enforcement capacity. Former GOP senator Richard Burr, a nicotine awareness activist, recently urged the Biden administration to take immediate action to restore order to the marketplace.

In a letter sent to Martin Makary, the FDA commissioner under Trump, as well as Health and Human Services Secretary Robert F. Kennedy Jr. and U.S. Attorney General Pam Bondi, Burr called for reforming the government's review process of nicotine and e-cigarette products, followed by a full enforcement against the entities responsible for growing the illicit market.

The Biden administration has taken several enforcement actions to control the flow of off-brand nicotine and e-cigarette products, particularly those manufactured and exported from China. One of the key actions included a joint federal operation by the US Food and Drug Administration (FDA) and US Customs and Border Protection (CBP) in December 2023. This operation seized 41 shipments containing approximately 1.4 million units of unauthorized e-cigarette products, with an estimated retail value over $18 million.

However, enforcement efforts have been perceived to fall short due to the sheer volume of illegal shipments, prolonged regulatory review processes, and challenges in fully controlling imports. Despite seizures and refusals, illegal e-cigarette sales have continued to rise, partly fueled by the large volume of off-brand imports from China evading enforcement.

The FDA's Premarket Tobacco Application (PMTA) review process delay has also complicated enforcement, creating a large grey market. The high volume of imports and the complexity of supply chains have made it difficult for customs and regulatory agencies to keep pace with shipments.

Manufacturers of illicit vaping products often use fraudulent shipping declarations and misclassified tariff codes to evade U.S. customs and trade laws. Approximately 85% of vapor and e-cigarette products sold in the U.S. are either illicit or unauthorized due to the Biden FDA's failure to enforce the law.

Burr also suggested providing clear regulations to the industry, enforcing the law against companies selling illicit products, and using regulation and oversight to drive down underage use. He further urged the FDA to advance a comprehensive, effective regulatory framework, which includes streamlining the FDA's approval process for less harmful smoke-free nicotine products.

The FDA and other agencies should build on these efforts and take comprehensive enforcement action against illegal e-cigarettes, particularly those popular among youth. Both Robert F. Kennedy Jr. and Donald Trump have expressed support for a healthier America, with Kennedy stating that kids should eat healthier and be actively involved.
